These Terms of Service (“Terms”) govern your access to and use of https://rebelmoth.com (the “Site”) and the purchase of products from Rebel Moth (“we”, “us”, “our”).

By visiting the Site, creating an account, or placing an order, you agree to these Terms. If you do not agree, do not use the Site or Services.

2) The Store and Shopify

The store is hosted on Shopify. Shopify provides the e-commerce platform that allows us to sell products and services to you. Your use of the Site may also be subject to Shopify’s own terms and privacy practices.

3) Eligibility

You must be at least the age of majority in your jurisdiction (or have permission from a parent/guardian) to use the Site and place orders. You agree to provide accurate information and not use the Site for unlawful purposes.

4) Accounts

You may create an account for faster checkout and order tracking. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. We may suspend or terminate accounts for misuse, fraud, or violations of these Terms.

5) Products and availability

We try to display product information accurately (including colors, prints, and sizing), but:

colors may vary depending on your screen and lighting,
sizing may vary slightly by manufacturer and production batch,
hand-finished items (including jewelry) may have small natural variations.

Product availability can change without notice. We may limit quantities per order or per customer.

6) Pricing, taxes, and currency

Prices are shown on the Site in the currency displayed at checkout. Prices may change at any time without notice, but changes won’t affect orders already paid.

Depending on destination and local laws:

EU orders (including UK): may include VAT where applicable and the checkout total is final.
United States (DDP): Orders shipped to the USA are sent DDP (Delivered Duty Paid). Any applicable import duties/tariffs are prepaid by us, and the checkout total is final—no additional duty/tariff charges will apply on delivery.
Other destinations: may be subject to customs duties, import taxes, and handling fees which are the customer’s responsibility.

7) Orders, payment, and confirmation

By placing an order, you make an offer to purchase. An order is considered accepted once we send an order confirmation and/or shipping confirmation (depending on processing). We reserve the right to refuse or cancel orders due to suspected fraud, pricing errors, stock/production issues, or policy violations.

Payments are processed via Shopify Payments and/or PayPal. We do not store your payment card details.

8) Processing time, shipping, and delivery

Processing times and delivery estimates are described in our Shipping Policy. Delivery timeframes are estimates, not guarantees.

Orders may ship in multiple packages if items come from different origins (e.g., clothing fulfillment partners and jewelry shipped from Bulgaria). Multiple tracking numbers may be issued.

We are not responsible for delays caused by carriers, customs, severe weather, peak seasons, or events outside our control.

For US deliveries, shipments are sent DDP, meaning duties/tariffs (if applicable) are prepaid by us and no additional charges apply upon delivery.

9) Address accuracy and unclaimed parcels

You are responsible for providing a complete and correct shipping address. If a shipment is returned due to incorrect address, refusal, or being unclaimed, reshipment/refund handling follows our Refund & Return Policy.

10) Returns, refunds, and cancellations

Our cancellation, return, and refund rules are set out in our Refund & Return Policy, which forms part of these Terms.

If you are a consumer in the EU/EEA/UK, your statutory rights (including the 14-day right of withdrawal where applicable) are not affected by these Terms.

11) Personalized/custom items and non-returnable exceptions

Certain items made to your specifications (personalized/custom) may not be eligible for withdrawal/return except when defective or incorrect, as explained in our Refund & Return Policy.

12) Incorrect, damaged, or defective items

If your order arrives damaged, defective, or incorrect, you must contact us within the timeframe stated in our Refund & Return Policy so we can investigate and offer a remedy (replacement/refund as appropriate).

13) Promotions, discount codes, and gifts

Discount codes and promotions:

may be time-limited,
may not combine unless explicitly stated,
may exclude certain items (e.g., personalization fees, shipping upgrades).

We may modify or end promotions at any time.

14) Intellectual property

All Site content (including designs, graphics, logos, photos, texts, and product names) is owned by or licensed to Rebel Moth / Norse Wind Ltd. and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or commercially exploit our content or designs without written permission.

15) User content (reviews, photos, comments)

If you submit reviews, images, or other content to the Site or to us:

you confirm you have the right to share it,
you grant us a non-exclusive, worldwide, royalty-free license to use it for store operations and marketing (e.g., showing reviews, reposting customer photos), unless you explicitly request otherwise in writing.

We may remove content that is unlawful, abusive, misleading, or violates third-party rights.

16) Prohibited uses

You agree not to:

violate any law or regulation,
attempt to gain unauthorized access to the Site or systems,
transmit malware or scrape data,
commit fraud or misuse payment methods,
harass, threaten, or abuse others,
infringe intellectual property rights.

We may restrict access or cancel orders when misuse is suspected.

The Site may include third-party services or links (e.g., payment providers, social platforms, analytics). We are not responsible for the content, policies, or practices of third parties. Their terms and privacy policies apply.

18) Disclaimer of warranties

The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation of the Site.

Nothing in these Terms limits statutory consumer guarantees that cannot be excluded under applicable law.

19) Limitation of liability

To the fullest extent permitted by law, Rebel Moth / Norse Wind Ltd. will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, arising from your use of the Site or products.

Where liability cannot be excluded by law (including under mandatory consumer protection rules), our liability is limited only to the extent permitted by those laws.

20) Indemnification

You agree to indemnify and hold harmless Rebel Moth / Norse Wind Ltd. from claims, losses, liabilities, and expenses arising out of your breach of these Terms, unlawful use of the Site, or violation of third-party rights.

21) Force majeure

We are not responsible for failure or delay in performance caused by events beyond our reasonable control (carrier disruptions, customs delays, natural disasters, strikes, war, outages, pandemics, etc.).

22) Governing law

These Terms are governed by the laws of Bulgaria. If you are a consumer in the EU/EEA/UK, you may also benefit from mandatory consumer protection laws in your country of residence.

23) Changes to these Terms

We may update these Terms to reflect changes to our business, the Site, or legal requirements. Updates will be posted on the Site with a revised “Last updated” date. Continued use after changes means you accept the updated Terms.
